Impact Home Buyers buys houses. We are not a law firm, foreclosure defense attorney, or HUD-approved housing counselor. This article is general information, not legal advice. Talk with your lender and a Kentucky attorney about your facts. If you need housing counseling, find a HUD-approved counselor at https://www.hud.gov/findacounselor or call 800-569-4287.
Falling behind on a mortgage is frightening. Letters arrive. Phone calls stack up. It is easy to freeze. Kentucky foreclosure is a court process, which often gives more time than people expect, but it is not unlimited time. Acting early keeps more options open.
This guide covers what “early” looks like in plain language, the kinds of options owners compare, and where a cash sale to Impact can fit. For the service page built around this problem, start at Behind on your mortgage.
Kentucky foreclosure is a court process
Kentucky generally uses judicial foreclosure. That means a lawsuit and court steps before a sale date. Exact timing depends on the lender, the court, and whether the homeowner responds. Do not treat a blog post as a calendar for your case.
What to do in the first stretch:
- Open every letter. Note any sale date, hearing date, or deadline.
- Call your loan servicer and ask what loss-mitigation options exist for your loan.
- Talk with a Kentucky attorney if a lawsuit has been filed or you do not understand the papers.
- Keep records of every call and mailing.
Impact can discuss a sale while you do those things. We cannot stop a court process by ourselves. A completed sale that pays the lender off, when timing and title allow, is one path owners use before a sale date.
Options owners commonly compare
Work with the lender. Loan modification, repayment plans, forbearance, or other loss-mitigation programs may apply. Only your servicer can say what is available on your loan.
Housing counseling. A HUD-approved counselor can help you understand letters and options. Find a HUD-approved counselor at https://www.hud.gov/findacounselor or call 800-569-4287. Counseling is separate from selling.
Short sale. Selling for less than the payoff with lender approval. Timelines and approval rules vary. This is not Impact’s default path; ask your attorney and lender.
Cash sale to a buyer. If equity, timing, and title support it, selling as-is for cash can pay off the mortgage and related costs and let you move before a foreclosure sale. See How we buy houses.
Doing nothing. Deadlines continue. Options usually shrink as a sale date approaches.
Fair Housing note: we evaluate each property and situation on its own. We do not treat sellers differently based on protected characteristics.
Where a cash sale can fit
A cash sale is not a magic stop button. It can fit when:
- You want a set closing date and a buyer who is not waiting on a new mortgage approval
- The house needs repairs you cannot fund before a retail listing
- You need to avoid months of showings while the clock runs
- Paying the loan off through a sale is better for you than other paths your advisor outlines
After you reach out, we walk the house with you. Then we lay out three paths side by side:
Cash as-is. Impact buys the house as it sits. You do not have to complete repairs or prepare showings.
Fix2List. If updates would support a stronger retail outcome and timing allows, Fix2List can fit. We pay for updates up front, and the cost comes out at closing.
Key 2 Close Realty listing. If a traditional MLS listing is the better fit and time allows, that path is available through Key 2 Close Realty. Listings are handled by Key 2 Close Realty, a separate company.
You choose. There is no pressure to pick cash if another option serves you better.
What we need on day one
- Property address and your contact info
- Rough condition notes and occupancy (owner, vacant, tenants)
- Whether a foreclosure suit has been filed, and any known sale or hearing dates (from your papers)
- Mortgage company name if you have it, and whether you are in contact with them
- Any other liens you know about (taxes, HOA, judgments)
We still walk the house before we put a number on paper. Photos help. The walk-through is step 2.
Timeline honesty
We can make a no-obligation cash offer in as little as 24 hours after we have what we need, and close in as little as 7 days, or later if you need time. Title work, payoff quotes, and court timing can take longer. If a foreclosure sale date is very close, say so on the first call so we can tell you quickly whether a sale path is realistic.
We close at a local title company. Payoffs and liens are handled through closing when the numbers work.
Lexington and Central Kentucky note
Many of the calls we get are from Lexington and Fayette County, plus nearby counties we already serve. Local detail for Lexington sellers lives on We buy houses in Lexington KY. Northern Kentucky owners in towns we serve can use the same process; see the town pages linked from the homepage Areas we serve section.
